Management of sports associations and federations and international migration
La communauté internationale connaît une crise migratoire grave depuis une dizaine d’années. Cette crise a été à la base d’un processus initié par les Nations Unies afin de trouver une réponse durable et efficace aux flux migratoires massifs de cette période. Cela a abouti à l’adoption du Pacte mondial sur les migrations, à Marrakech, et approuvées par l’Assemblée générale des Nations Unies, en décembre 2018. L’objectif de ce Pacte est de réaffirmer les règles et principes existants en droit des migrations internationales en vue d’avoir un système de migrations sûres, ordonnées et régulières.
Le Pacte mondial sur les migrations vise à renforcer la coopération internationale d’une part, et la responsabilité partagée des Etats en termes de politique migratoire de l’autre. Le pacte comporte ainsi trois objectifs principaux : (i) la réorientation par les Etats de leurs politiques de développement nationale et internationale vers la question migratoire ; (ii) le renforcement de la coopération internationale des Etats en vue de garantir une lutte plus efficace contre les passeurs et le trafic d’êtres humains, ainsi qu’une meilleure protection des victimes ; et (iii) l’amélioration par les Etats des voies régulières de migration.
Parmi les domaines dans lesquels prévaut un système ordonné des migrations, il convient de mentionner les mobilités transfrontalières pour des raisons sportives, dont le régime est bien développé et mis en œuvre dans le cadre des fédérations sportives. La Suisse a le privilège d’abriter plusieurs de ces fédérations, dont la Fédération internationale de football association (FIFA), dont le siège est à Zurich ; le Comité international olympique (CIO), basé à Lausanne ; ainsi que l’Union européenne de football association (UEFA), installée à Nyon. A ces fédérations faîtières à caractère universel ou européen, il convient d’ajouter de nombreuses autres à caractère national dans les sports aussi variés que le football, le hand-ball, le basket-ball, l’athlétisme, la hockey, l’alpinisme, etc.
Le présent projet vise à examiner des études de cas des règles aux transferts internationaux afin d’identifier de bonnes pratiques de migrations internationales sûres, régulières et ordonnées conformes aux principes adoptés dans le Pacte mondial sur les migrations.
The international community has witnessed, over the last ten years, a major migration crisis. This crisis led to a process started by the United Nations to find a lasting and efficient answer to the massive migratory fluxes of that period. It led to the adoption of the Global Compact on Migration, in Marrakech, approved by the General Assembly of the United Nations, in December 2018. The objective of the Compact is to reaffirm the rules and principles on the law on international migrations to enable a safe, orderly and regular migration system.
The Global Compact on Migration aims, on one hand, to reinforce international cooperation, and on the other hand to strengthen the shared responsibility of States as regards migration policies. The compact has three main objectives: (i) the reorientation by governments of their national and international development policy towards the migration issue; (ii) the strengthening of international cooperation of governments to guarantee a more efficient fight against smugglers and human traffickers, as well as a better protection for victims; (iii) improvement by governments of the regular migration routes.
Among the fields which have a well organised migration system, one must mention transborder mobility for sports, which is well developed and applied by the sports federations. Switzerland has the privilege of having several federations, such as International Football Association Federation (FIFA), in Zurich, the International Olympic Committee (CIO), based in Lausanne; as well as the European Union of Football Association (UEFA), in Nyon. To these key global or European federations, one must add numerous others with national coverage in sports as varied as football, hand-ball, basketball, athletics, hockey, alpine sports, etc.
The present project will examine case studies on the rules of international transfers so as to identify good practices in secure, regular and well-structured international migrations done according to the principles adopted by the Global Compact on Migration.
